Clarus Direct, LLC, d.b.a. LivePlayGo® ("LivePlayGo," "we," "us", “our”), is the owner of the site www.LivePlayGo.com (the "Site") and has developed this Privacy Policy, which details important information regarding the collection, use and disclosure of site visitor information collected on the Site. We provide this Privacy Policy to help you make an informed decision about whether to use or continue using the services found at our Site ("Services").

This Privacy Policy is incorporated into and subject to the Terms of Use and Terms of Service. Each time that you access or use the Site or our Services, you signify that you agree to be bound by the Terms of Use, the Terms of Service, and this Privacy Policy. If you do not agree to the terms of this Privacy Policy, you must discontinue using the Site and accessing the Services available on the Site.

INFORMATION WE COLLECT

There are three basic categories of information we collect:

  • Information you provide directly to us
  • Information collected as you use our Services
  • Information obtained from others (“Third Party(s)”)

Here is a little more detail on each of these categories.

Information You Provide

When you interact with our Services, we may store and make further use of the information that you provide to us. For example, to become a member we require you to set up an account, so we may collect a few details about you to create your profile, such as a name, a username, an account password, an email address where we can contact you, a phone number, gender and date of birth. You must also provide billing information (such as credit and/or debit card account information) as part of the account setup process. We may also ask you to provide us with some additional information that will be used in support of membership services, such as a profile picture or linked social media accounts.

From time to time, we may request information from Site visitors or members to allow for participation in promotions, contests, sweepstakes, offers, surveys, polls, or other engagement opportunities. Participation in these activities is completely voluntary, and you therefore have a choice whether or not to disclose this information. We may collect additional demographic, interest and behavioral data as part of these opportunities. If additional terms and conditions apply, you will see a notice at the time you provide your response.

When you contact customer support or communicate with us in any other way, we’ll collect whatever information you volunteer or that we need to resolve your question.

Information Collected When You Use Our Services

When you use our Services, we collect information about which of those Services you’ve used and how you’ve used them. We might know, for instance, that you bought a product or service from a certain brand, saw a specific ad, or took advantage of certain offers. Of course, you’ll also provide us whatever information you send through our Services, such as shopping transactions, loyalty memberships, receipts or proofs of purchase information. We and/or our third-party service providers also collect transaction information when you use our Services including offers redeemed and travel bookings.

Here’s more detail about the types of information we collect when you use our Services:

  • how you interact with our Services, such as search terms, filters, which filters you view or apply, or which search queries you submit.
  • your interests in brands, products or offers available through our Services and those of our third party affiliated Services.

We may use internal or third party session recording technology to better understand your use of the site.

Content Information. We collect content you provide by using our Services or create on our Services and information about the content you provide or create, such as if the recipient has viewed the content and the metadata that is provided with the content.

Device Information. We collect information from and about the devices you use. For example, we collect information about your hardware and software, such as the hardware model, operating system version, device memory, advertising identifiers, unique application identifiers, unique device identifiers, browser type, language, and time zone.

Camera and Photos. Some of our Services require us to collect images and other information from your device’s camera and photos. For example, you won’t be able to upload receipt photos from your camera roll unless we can access your camera or photos.

Location Information. When you use our Services we may collect information about your location. With your permission, we may also collect information about your precise location using methods that include GPS, wireless networks, cell towers, Wi-Fi access points, and other sensors, such as gyroscopes, accelerometers, and compasses.

This information may include the browser you are using, the Internet address from which you linked to our Site, your unique advertising ID, the operating system of your device (e.g., computer, smartphone, or tablet), the unique IP address (a unique number used to identify devices on the Internet) of the computer you used to access our Site, your physical location, and usage and browsing habits and may engage one or more service providers to assist us in collecting or analyzing this information.

Web Beacons. Our web pages contain "web beacons." Web beacons allow us to count site visitors that have visited a web page or opened an email that contains a web beacon and collect other types of aggregate information. Some of the web beacons that are in place on our Site are used only by us, and other web beacons are from our service providers, affiliates, vendors, and advertisers, which use this data to assist us in analyzing how our offers and Site are accessed and used.

Cookies. To help make sure you receive information that is relevant to you, our Site, our service providers, affiliates, and advertisements on affiliate sites use data "cookies." We use session cookies to make it easier for you to navigate our Site. A session ID cookie expires when you close your browser. We use persistent cookies to differentiate non-member visitors to the Site from registered users and members, to customize the content of certain sections of the Site, and to enable us to track and cater to the interests of site visitors, in order to enhance their experience on the Site. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your internet browser's privacy settings. We may collect information about you from other users, our affiliates and Third Parties. Here are a few examples:

Our clients include (but are not limited to) brands and agencies and various marketing data platforms and data compilers with whom we have agreements regarding the use and protection of data (“Clients”);
  • to create online targeting audiences for us or our Clients, we sometimes create defined audience segments based on common demographics and/or shared (actual or inferred) interests or preferences (e.g., households with tech professionals, or with an interest in winter travel). When we do this, we may work with a data partner that “matches” our Information through de-identification techniques (such as through coded data “hashing”) with online cookies and other identifiers, in order to target and measure ad campaigns online across various display, mobile and other media channels. You may learn more about how to opt out of this and other online ad targeting in the CONTROL OVER YOUR INFORMATION Section below;
  • to provide additional marketing services to our Clients (or that they may provide to their own customers) such as: (a) help with targeting and optimizing direct mail, email campaigns, display, social and mobile marketing; (b) measuring how effective marketing campaigns have been, by determining which messages are most likely to be seen or opened by which types of consumers, or which types of ads are most likely to lead to purchases; (c) analyzing and optimizing our Clients’ proprietary databases, or helping Clients to detect and prevent fraud; or (d) providing “validation” or data hygiene services, which is how companies update and/or correct their databases by verifying or removing or correcting old, incorrect or outdated information;

This may include contacting the retailer where a purchase was made to verify that an item was purchased, the amount paid, if a benefit was utilized, or if an item has been returned; and
  • for any other purposes identified or implied at the time of collection or described in this Privacy Policy.

If we have trouble processing a payment or your membership, the information may be used to contact you. When you provide us with information in connection with a particular activity or otherwise register for our Services or provide your contact information, including an email address or telephone number in connection with that activity, product, or service, you agree that this action constitutes a purchase or inquiry establishing a business relationship with us.

You consent to us communicating with you regarding future information about our Services using the information you provided to us. With your consent, we may contact you with pre-recorded calls and calls and text messages to your mobile telephone number (including use of automated dialing equipment). HOW SHARE INFORMATION

Our Service Providers. We may use third party service providers (which may include our affiliate companies) to help us operate our business and the Site or administer the Services and activities on our behalf, pursuant to our instructions and in compliance with applicable contractual, technical and organizational security measures. For example, we may partner with other companies to provide you member support services, travel booking services, authentication services, prevent fraud on our Services, process payments, administer our promotions, sweepstakes and surveys, perform analytics, maintain the accuracy of our databases, send emails and administer your savings or payments. Our service providers may be located outside of your country of residence, in which case that country's courts, governments or law enforcement agencies could obtain disclosure of your information in accordance with that country's laws. If you use the travel feature on our Site or select an alternative method of receiving your payouts, you are directing us to share your personal information, as necessary, with the relevant payment partner to facilitate those transactions. Any personal information we share with these partners or they collect themselves shall be subject to the partner's privacy and data security policies and at the time of your use of the services you may be asked to accept those policies and/or terms and conditions of use. We use any personal information provided to us by our service providers in accordance with the terms of this Privacy Policy. One or more of our service providers have asked that we share additional information with you: https://kount.com/legal/privacy-policy.

Ad Serving. To provide us with advertising and marketing services, we partner with certain Third Parties that automatically collect Internet and network activity information about your use of the Services, such as your browsing history, IP address, pages viewed, and links clicked, so that they can use this information to serve you ads for our Services on other sites. These Third Parties may also use this collected information to draw inferences about you for their own purposes or collect personal information about your online activities over time and across different websites (in addition to our Services) to help predict your preferences and to display (and enable other third parties to display) ads to you or others. We or our Third Party partners may develop audience segments which consist of combinations of various data, including consumer location activity, purchase intent, and online and offline interests based in part on your online activity. We or our Third Party partners may offer these audience segments for licensing by third party data providers and marketing partners. Note that this Privacy Policy covers only our use of data and does not include use of data by such Third Parties. We also may obtain information for this purpose from Third Party websites on which our ads are served. For example, we may use Remarketing with Google Analytics Remarketing, Demographics and Interest Reporting and Google Display Network Impression Reporting. You may learn more about how to opt out of this and other online ad targeting in the CONTROL OVER YOUR INFORMATION Section below.

We work closely with our subsidiary and affiliate companies and may share your personal information for our internal business administration. Some of our service providers with whom we share personal information, as described above, may include our subsidiary and affiliate companies. In addition, we may also share information with those corporate affiliates. These affiliates may use the information as described in this Privacy Policy and also analyze and monitor usage and trends to improve their services and websites. Our opt-out and delete request functionality described in the CONTROL OVER YOUR INFORMATION Section below will serve to remove you from this sharing.

Announcements. We may send you Service-related announcements and emails from time to time relating to your account. These include emails such as order confirmations, renewal/expiration notices, and payment-card problem notifications. We may also send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if any service is temporarily suspended for maintenance, the delivery of a Service is delayed, or if there is some Service issue with something you might have requested, we might send you a notice. Even if you have opted out receiving marketing communications from us, please be aware that we may still contact you with these Service-related messages.

Legal Matters; Safety. We may, without your express consent, access and disclose your information, any communications sent or received by you, and any other information that we may have about you or your account as may be permitted or required by law (including, but not limited to, court order, subpoena or other legal process), or to prevent or investigate suspected fraud, violations of our Terms of Use or Terms of Service, or activity that appears to us to be illegal or may expose us to legal liability. Additionally, we may disclose your information in situations that we believe to be emergencies involving potential threats to the physical safety of any person or property if we believe that your information in any way relates to that threat.

Sale or Transfer of Business or Assets. In the event that we, or any of our businesses, are sold or disposed of as a going concern, whether by merger, sale of assets, or otherwise, or in the event of an insolvency, bankruptcy, or receivership, personal and non-personal information of our visitors and registered users and members may be one of the assets sold or merged in connection with that transaction. Information about our visitors may also need to be disclosed in connection with a commercial transaction where we or any one of our businesses are seeking financing, investment, support, or funding.
